Welcome to Xeesty! These Terms of Use ("Terms") govern your access to and use of our platform, which includes:

  • Our website: www.Xeesty.com ("Website")
  • Our mobile app: Xeesty ("App")
  • Products available for purchase through our Website and App ("Products")
  • Services provided through our Website, & App ("Services")

Collectively, we call all of the above our "Platform."

By using our Platform, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Platform.

Important Notice Regarding Dispute Resolution:

These Terms contain provisions that affect your legal rights. Please read the "Governing Law and Dispute Resolution" section carefully as it outlines how any disputes between you and Xeesty will be resolved.

1. What Xeesty Does: Connecting You to Healthcare Professionals

Xeesty (Hinze Tech Operations Ltd) provides the Platform that connects you with independent healthcare practitioners ("Providers"). These Providers are part of a network ("Provider Network") offering services from hospital treatments to lifestyle coaching. Xeesty does NOT provide medical advice or treatment.

2. Independent Providers, Not a Single Medical Entity

The Providers are independently contracted/employed by Medical Groups and are NOT directly employed by Xeesty. While Providers use the Xeesty platform to deliver the Services, each Xeesty-branded practice is independently owned and operated. There is no single "Xeesty" medical provider. Xeesty does not supervise, control, or direct in any way the medical care provided by the Providers. For any questions about your medical care, contact your Provider directly, and we always recommend consulting with your general practitioner (GP) and other healthcare professionals.

3. No Medical Emergencies

Our Platform is NOT for medical emergencies. If you have a medical emergency, call 999 (or your local emergency number) immediately. Do not delay seeking medical help based on information on our Platform. If Xeesty or a Provider believes you have an emergency, you will be directed to emergency services. You should continue to consult with your general practitioner (GP) and other healthcare professionals as recommended. Always seek professional medical advice for any health questions and before making any changes to your treatment plan.

4. Telehealth Risks

Using our Services involves certain risks associated with remote healthcare, including:

  • Inaccurate AI Transcriptions: Voice-captured information using AI transcripts may be inaccurate.
  • Insufficient Information: Transmitted information may not be sufficient for proper medical decisions (e.g., poor image quality).
  • Delays: Delays in evaluation or treatment due to network or computer failures.
  • Limited Medical Records: Lack of access to your complete medical history could lead to errors.
  • Security Risks: Although we use security protocols, electronic systems could still experience breaches, compromising your health information.

By using our Platform, you acknowledge and accept these risks.

5. Your Privacy

Your privacy is important to us. Information you provide on our Platform is governed by our Privacy Policy, which complies with UK data protection laws, including the Data Protection Act 2018 and the UK GDPR. Information related to the Services you receive may also be governed by the applicable Medical Group Notice of Privacy Practices. Please review these documents carefully.

6. Prescriptions

Some Products require a valid prescription from a registered healthcare professional. You can only obtain a prescription product if:

  • You have a consultation with a Provider through our Platform.
  • The Provider determines the product is appropriate for you.
  • The Provider writes a prescription.

You can fill the prescription at the pharmacy of your choice. Prescriptions are solely for your personal use. Read all product information carefully and contact a healthcare professional if you have any questions. You have the freedom to choose which pharmacy your prescription is sent to.

7. Not Insurance

Xeesty is not an insurance company. The fees you pay for Services are not insurance premiums. If you want health insurance, you must purchase it separately.

8. Ownership of the Platform

Xeesty owns all content and materials on the Platform, including software, text, images, logos, and trademarks ("Content"). You are allowed to use the Platform for personal, non-commercial purposes only. You cannot copy, distribute, modify, or create derivative works from our Content without our permission. Unauthorised use of our Platform is a violation of these Terms and may violate copyright, trademark, and other laws, including the Copyright, Designs and Patents Act 1988.

9. Platform Access and Security

You may not violate the security of our Platform. This includes accessing data you are not authorised to access, testing the vulnerability of our systems, or using automated means to access or copy data. We will investigate security violations and cooperate with law enforcement.

If you access a protected area of our Platform, you must keep your user ID and password confidential. You are responsible for all activity under your account. We can revoke your access at any time.

10. User Content

If you submit content to our Platform, you agree not to post anything that is false, inaccurate, harmful, or violates the rights of others, and you must adhere to the laws of England and Wales. You grant Xeesty a license to use and share this content. We are not responsible for User Content. We may remove any content that we deem to be inappropriate or unlawful.

11. Age Restriction

You must be 18 years or older to use our Platform.

12. Your Account Information

You agree to provide accurate and complete information when registering for an account and to keep your information updated. We may suspend or terminate your account if your information is inaccurate or incomplete. You are responsible for maintaining the confidentiality of your password.

13. Information Accuracy

We try to ensure the accuracy of our Platform, but we make no guarantees. The Platform may contain errors, and information may change without notice. We are not responsible for information posted by unaffiliated third parties.

14. Pricing Errors

We reserve the right to refuse or cancel orders for Products or Services listed at an incorrect price due to a typographical error. If your credit card has been charged, we will issue a credit for the incorrect price.

15. Copyright Infringement

If you believe your copyright has been infringed, please provide us with a notice of an alleged copyright infringement at the address below in the contact us section.

16. Orders and Payments

  • Online Payments: You can purchase Products or pay for Services on the Platform. Xeesty uses third party to ensure compliance with Payment Card Industry Data Security Standard (PCI DSS).
  • Refunds: In cases where a provider determines a patient is not suited for treatment on the Xeesty platform, a refund of the initiation fee will be granted. Your statutory rights are not affected.
  • Subscriptions: Your subscription will automatically renew unless you cancel before the end of the current period. We do not offer refunds for partial billing cycles. We may change the subscription price, with advance notice. You can reject the change by unsubscribing.
  • Payment Information: You agree that all payment information you provide is accurate and that you are authorised to use the payment method.

17. Order Acceptance

We reserve the right to refuse or cancel any order for any reason, subject to your statutory rights as a consumer.

18. Links to Other Sites

We are not responsible for the content of any third-party websites linked to from our Platform. Accessing those sites is at your own risk.

19. Consent to Receive Communications

By providing your phone number, you agree to receive text messages from us regarding your account and our Services. Message and data rates may apply. You can opt out by replying "STOP." We may also record interactions with us or your Provider for quality assurance and training purposes, in accordance with UK data protection laws.

20. Marketing Communication Compliance

Xeesty are committed to complying with the Privacy and Electronic Communications Regulations 2003 (PECR). Any marketing communications you receive from us will be compliant with the applicable regulations.

21. Electronic Communications

By using our Platform, you consent to receive electronic communications from us.

22. External Services

Our Platform may enable access to third-party services and websites. We are not responsible for these External Services, and your use of them is at your own risk.

23. Special Terms for Providers

This section applies only to healthcare providers using our Platform.

  • Independent Practice: You are responsible for complying with all laws and regulations applicable to your profession, including those set by the General Medical Council (GMC) or other relevant regulatory bodies.
  • No Medical or Legal Advice from Xeesty: Xeesty does not provide medical or legal advice.
  • Professional Judgment: The Platform is not meant to substitute or modify your professional judgment.
  • Indemnification: You agree to indemnify Xeesty from any claims arising from your use of the Platform and the services you provide.
  • Provider Content: You are responsible for the content you provide to patients and must obtain all necessary consents, complying with UK data protection law.

24. No Third-Party Rights

These Terms are for the benefit of you, Xeesty, the Medical Group, and our affiliates only, and do not create any rights for third parties under the Contracts (Rights of Third Parties) Act 1999.

25. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. We will always look to settle complaints amicably with you.

26. Limitation of Liability

Nothing in these Terms shall exclude or limit Xeesty's liability for:

  • Death or personal injury caused by its negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability that cannot be excluded or limited under English law.

Subject to the above, Xeesty's maximum aggregate liability to you with respect to your use of the Platform and Services is £500.

27. Force Majeure

We are not responsible for any failure or delay in performing our obligations due to events beyond our reasonable control (e.g., natural disasters, war, government actions, pandemic).

29. Revisions; General

We may revise these Terms from time to time and the latest revision date will be posted here. Your continued use of the Platform after any revisions constitutes your agreement to the revised Terms. These Terms constitute the entire agreement between you and Xeesty.
